文匯報 2021年5月17日 【恒大譯站】單獨關稅區 不怕美制裁 2020年7月，時任美國總統特朗普宣布對香港實施貿易制裁，不再把中國內地和香港區分開來。中美貿易戰爆發，美國向來自中國內地的進口貨加徵關稅，但由於過去美國給予香港特殊待遇，所以並未向來自香港的進口貨加徵關稅。特朗普作出上述宣布，意味着將會對香港貨「一視同仁」。美國海關及邊境保衛局在同年8月發出通告，要求所有來自香港的進口貨均須標籤為「Made in China」。 香港在國際貿易方面享有特殊地位，並不是外國的恩賜，除了香港人的努力，還有其法律基礎。根據基本法第一百一十六條，香港特別行政區為單獨的關稅地區（separate customs territory）。請各位注意：「單獨的關稅地區」才是正確的說法，不是「獨立關稅區」。Separate customs territory是國際法概念，作為單獨的關稅地區，香港可以參加《關稅和貿易總協定》（General Agreement on Tariffs and Trade），亦即世界貿易組織（WTO）的前身。WTO正式成立，香港也順理成章成為該組織的成員，比中國內地入世還要早。這裡順帶一提，因為WTO屬於「不以國家為單位參加的國際組織」（international organizations not limited to states），所以香港可以 「中國香港」的名義參加。 香港是個單獨的關稅地區，可以自行徵收關稅和編制進出口數字。當然，香港一向都是個自由港，只會向幾種進口貨徵收稅項。除了作為單獨的關稅地區，香港也可以對本地產品簽發產地來源證（certificates of origin）。關於這一點，基本法第一百一十七條已作出相關規定。香港可以自行簽發產地來源證，因此「香港製造」跟「中國製造」是不一樣的。年輕的讀者朋友可能不知道，香港在上世紀70年代是個工業城市，「Made in Hong Kong」這個「品牌」在國際社會早已享負盛名。中國內地在1978年實施改革開放後，香港廠商才逐步將生產基地轉移到內地。今時今日，香港已經是個國際金融中心，經濟以服務業為主。 大家可能會問：美國對香港實施貿易制裁，對香港會造成嚴重打擊嗎？大家不用擔心！影響是有的，但應該不會如一般人想像那麼嚴重。其實美國早已不再是香港最大的貿易夥伴。出口到美國的貨品，佔香港出口總值不到10%。在香港的出口貨品中，轉口（re-exports）佔絕大部分，本地產品出口品（domestic exports）佔比很低。當然，我們也不應該淡化美國實施貿易制裁對香港的影響，反而應該嚴陣以待，見招拆招。就以轉口貿易為例，在中美貿易戰爆發以前，很多香港廠商早已逐步將生產基地從中國內地轉移到東南亞國家。 國際貿易是互惠互利的，念過經濟學的朋友，定必記得「比較優勢」（comparative advantage）這個概念。國際社會好比一個大家庭，大家分工合作，集中力量生產具有比較優勢的產品，再通過國際貿易進行交易，互通有無。如果一部iPhone的所有硬件都在美國本土生產，大家猜猜要賣多少錢？拜登上場，中美兩國的緊張關係未見緩和，上次兩國在阿拉斯加舉行會談，火藥味甚濃。事態發展如何，大家拭目以待。 張敬文博士 香港恒生大學翻譯及外語學院講師 …
